The United States Department of Agriculture, Agricultural Research Service, hereinafter referred to as ‘ARS’, and the UK Food Standards Agency, hereinafter referred to as ‘the Agency’, and jointly referred to as ‘the Participants’, hereby affirm their mutual interest in and desire to broaden co-operative research programs and exchanges. The Participants recognize that cooperation is a matter of working together toward common goals of mutual interest, mutual understandings and efficient administration of cooperative programs, including but not limited to cooperative financing and/or the sharing of research activities. Nothing in this broad understanding is to be construed as interfering in any way with the basic responsibilities and authority of either of the Participants for independent action. The purpose of this MOU is to strengthen the cooperation between the Participants in a collaborative effort to enhance the provision of advice on science and policy to their respective Governments, in the fields of the Participants’ mutual interest/remits. To this end, the Participants intend jointly to explore and coordinate research activities of mutual interest which are to be implemented by mutual understanding and in conformance with the regulations and policies of both Participants.

Each Participant's participation in the cooperative activities under this MOU is subject to the availability of funds, resources, and personnel and is to be conducted in accordance with the laws and regulations of that Participant’s government. This MOU does not create any legally binding obligations between the Participants. This MOU is not intended to, and does not create any right, benefit, or trust responsibility, substantive or procedural, enforceable at law or in equity, by a party against the United States, its agencies, its officers, or any other person. Nothing in this MOU obligates either Participant to commit or transfer any funds. All collaborative activities are to be mutually determined by the Participants and may be described in, and subject to, a mutually agreed individual plan of work that will delineate arrangements between Participants that are specific for each activity. Such activity-specific, individual plans are to address goals and objectives, working plans, research methodologies, and procedures, and are to be prepared jointly by the Participants. Such activities are to be independently authorized by appropriate statutory authority. This MOU does not provide such authority. Specific work projects or activities that involve the transfer of funds, services, or property between the Participants are to be executed through separate agreements and are to be contingent upon the availability of appropriated funds. The negotiation, execution, and administration of subsequent written arrangements are to comply with all statutes and regulations.
